Ombudsman Requests Constitutional Review of Minor Offences Act

The Human Rights Ombudsman of the republic of Slovenia has requested a constitutional review of the provision of the minor offences act dealing with fine enforcement by imprisonment, arguing that the provision violates the basic human rights and fundamental freedoms.

The provision says that a court can decide whether people who fail to pay a fine in part or in entirety are to be sent to detention in order to force them to pay.

According to the human rights ombudsman, this provision is in violation of the Constitution and should be reviewed by the Constitutional Court.
