Delays persist in deciding on rights under the Act on the Social Inclusion of Persons with Disabilities

The Ombudsman notes that there are still delays in deciding appeals against decisions on rights under the Social Inclusion of Persons with Disabilities Act. The complainant, who turned to the Ombudsman in this regard, has been waiting for a decision for more than a year, and the ministry is dealing with several other complaints for which the deadline for a decision has already expired.

The Human Rights Ombudsman (Ombudsman) was contacted by the complainant who appealed against the decision on the recognition of the status of a disabled person under the Social Inclusion of Disabled Persons Act (ZSVI) and after a year has not yet received a decision on their appeal.

The Ombudsman made an inquiry to the Ministry of Labour, Family, Social Affairs and Equal Opportunities (MDDSZ) about the timing of the decision on the complainant's appeal, and the MDDSZ made a decision on the appeal immediately after receiving the Ombudsman's inquiry.

At the request of the Ombudsman, the MDDSZ explained that the current backlog in resolving complaints for rights under the ZSVI amounts to 11 months, that there are 24 complaints pending, whose decision deadline has already expired, and that they are currently (the Ombudsman received the explanation from the MDDSZ on 12/06/2024) resolving complaints that were due in July 2023. The MDDSZ also announced that it is implementing measures to eliminate the backlog, and the Ombudsman expects that these measures will be successful and effective. 9.2-7/2024
